MANILA, PHILIPPINES — According to a new law signed by President Rodrigo Duterte, government workers will now get a night shift differential pay. 

Government employees, including those in government-owned or controlled organizations (GOCCs), are entitled to a night shift differential pay under Republic Act (RA) No. 11701, which was signed by Duterte on April 13. 

“Government employees occupying position items from Division Chief and below, or their equivalent, including those in government-owned or -controlled corporations, whether the nature of their employment is permanent, contractual, temporary, or casual, shall be paid night shift differential at a rate not exceeding 20 percent of the hourly basic rate of the employee, as determined by the head of the agency, for each hour of work performed between the hours of 6 in the evening and 6 in the morning of the following day,” the law read.

Sen. Ramon “Bong” Revilla, Jr. previously stated that the bill essentially changes the Magna Carta of Public Health Workers, which states that public health workers are only entitled to 10% of their regular pay as night shift differential pay.



However, the newly signed law does not apply to the following government employees:

  • Government employees with office hours between 6 a.m. and 6 p.m. Overtime pay are paid for services rendered outside of typical 8-hour work schedules.
  • Workers of the government whose services are necessary or on-call 24 hours a day, such as military uniformed personnel, police, the jail bureau, the Bureau of Fire Protection, and others as defined by the Civil Service Commission and the budget department.

The amount must be assessed against existing expenditures for the departments, bureaus, offices, and agencies concerned in national government institutions.

Following that, any additional funds required to carry out this act must be included in the annual general appropriations act.

For GOCCs and their subsidiaries, the payment will be assessed against their respective corporate funds
